Intense H-1B Lottery Competition and Impending Reforms
It's no secret how fierce H-1B application competition has become in recent years.
According to official USCIS data, electronic registrations for H-1B in FY 2024 saw another significant jump, surging to 780,884!
However, only 188,400 were selected, resulting in a success rate of less than 25%.
Historical data shows that the number of H-1B applicants began skyrocketing in 2020, reaching nearly 500,000 last year.
In October this year, the Department of Homeland Security (DHS) announced a proposed rule to update the H-1B visa program.
To completely eliminate the abuse of multiple registrations and fraudulent entries, the proposed rule would replace the current "one registration, one lottery" system with "one person, one lottery". This means each beneficiary would be entered into the lottery only once, regardless of how many employers submit registrations on their behalf.
The proposal also extends the H-1B CAP-GAP policy protection to April 1st of the same fiscal year, offering students more flexibility.
The comment period for this proposal has ended, and the final rule may be implemented for FY2025.
Regardless of how the H-1B reform ultimately unfolds, those planning to participate in this year's lottery should start preparing now. CheersYou（清柚教育） will outline this year's H-1B application timeline and key considerations.
2024 H-1B Application Timeline
Although the official H-1B registration period is in March, the fact that a sponsoring employer is required means January is essentially the deadline for confirming eligibility to apply for H-1B.
Here is the detailed H-1B application timeline:
January - February
If you already have a job offer, make sure to ask your employer whether they are willing to sponsor your H-1B lottery this year.
If your current company does not provide sponsorship but you still want to participate in this year's lottery, you'll need to quickly find a new job with a sponsoring employer in January or February. Keep in mind that the employer's qualifications significantly impact the outcome of your H-1B petition, so choose carefully.
For small companies or employers with little experience in the H-1B process, they may not be familiar with the procedures. We recommend working closely with an attorney and taking an active role yourself; gather necessary materials early and address any issues promptly.
March
Based on past years, USCIS's electronic registration system typically opens between March 1st and March 17th. Employers and attorneys can start entering information and paying the $10 registration fee for each employee. Once submitted, the employee status in the system should show as "Submitted".
It's best to remind your employer or attorney to complete the registration early to avoid last-minute errors. Note that all USCIS deadlines are based on Eastern Time; the registration deadline for 2024 is 5 PM ET on March 20th.
Once USCIS receives enough registrations by the deadline, it will randomly select 85,000 registrations — 65,000 under the Regular Cap and 20,000 under the Master's Cap.
H-1B lottery results are usually released starting March 25th and continue through March 31st. If you're not selected in the initial round, there may be a second-chance selection around July.
April - June
First-round selection results are usually posted by April 1st. If your registration shows "Selected", congratulations! You can start preparing the Labor Condition Application (LCA).
You will then have 90 days to submit all required petition materials — make sure to file within this window, or your application will be denied. During this time, work with your attorney to compile and mail the LCA, petition forms, filing fees, and support documents to USCIS.
USCIS typically takes 2-3 months to adjudicate H-1B petitions. With Premium Processing, you can receive a decision within 15 calendar days.
July - September
If you don't receive a Request for Evidence (RFE), you can wait for approval and start working on October 1st!
If there are issues with your application and you receive an RFE, you must respond with the requested evidence by the deadline provided by USCIS.
Receiving an RFE is not a cause for panic — less than 3% of RFE cases are ultimately denied. Simply provide the requested documents as instructed. RFE processing times may extend beyond October 1st, so we recommend using Premium Processing to get a result sooner and plan your next steps.
The lottery is the only uncontrollable part of the H-1B process. However, by carefully selecting your employer, working with an experienced attorney, and meticulously preparing your petition materials, you can maximize your chances within the elements you can control.
How International Students Can Prepare for H-1B
Choose the Right Major and Employer
According to FY2022 USCIS data, STEM-related jobs account for the majority of H-1B approvals.
Computer science is the most advantageous field. Among approved H-1B occupations, computer-related roles made up nearly 70%.
Additionally, fields like management and education also have some representation, showing that liberal arts graduates still have opportunities to secure H-1B status and stay in the U.S.
USCIS data shows that tech companies lead overwhelmingly in H-1B sponsorship approval rates, accounting for 46% of total selections. Manufacturing, information, finance/insurance, and education services follow.
Materials Required
It is essential to have all required materials ready for the H-1B application period.
First, the basic requirements for an H-1B visa include:
▪️ The position must require specialized knowledge and a professional role.
▪️ The beneficiary must hold at least a bachelor's degree or its equivalent, or have equivalent experience.
▪️ The employer must pay at least the prevailing wage for the position in that location.
Next, materials the applicant must submit include:
- Latest resume and I-94 records
- Diploma and official transcripts
- Scanned copies of passport and visa
- Previous I-20s from your university, etc.
If you are on STEM OPT, you will also need to provide:
- Copy of STEM OPT EAD card (if applicable)
- Most recent I-20 from your DSO showing OPT authorization
- Electronic I-94 showing your student status
- Pay stubs from your OPT employment
- Form I-983 Training Plan for STEM OPT students
Start Early and Maintain a Positive Mindset
After familiarizing yourself with the H-1B process, early and thorough preparation is the key to success.
Choosing the right major, confirming your career direction, consulting with an attorney, maintaining active communication with your company, submitting resumes, selecting a sponsoring employer... there is a lot to do for the H-1B lottery. We suggest you start preparing as early as possible.
Of course, whether you're selected in the H-1B lottery often feels like a gamble. Some get selected on their first attempt, while others miss out four times — it truly depends on luck.
Maintain a positive mindset and approach the outcome with equanimity. Consider all your options and adjust your plans as needed.
If you are not selected, be sure to have backup plans, such as continuing your education or utilizing CPT. Only by preparing for all possibilities can you maximize your chances of success.
